In 1993, the Minnesota Supreme Court held in Skeen v.
State that Minnesota students had the fundamental right to receive an
“adequate” education. Dissenting in Skeen, Minnesota Supreme Court
Justice Alan Page (ret.) noted the lack of equal opportunities for all Min
nesota children, citing Brown v. Board of Education, the landmark
U.S. Supreme Court case. Twenty-eight years later, while Minnesota is a nat
ional leader in education on some dimensions, the state’s efforts have not
translated into better outcomes for students of color, Indigenous students,
and those from low- or moderate-income families.
With the int
roduction of the Page Amendment, the proposal to make a quality public educ
ation a fundamental right for all children in Minnesota, the conversation i
ncludes the legal system’s role in education policy.

on Injustice Legal Detail (WILD) and Twin Cities Diversity in Practice (TCD

te case and its long-standing implications for public education in Min
nesota. WILD is an affi
liate non-profit of TCDIP focused on eliminating anti-Black racism and all
forms of racism in Minnesota.
We will talk with Justice Page (ret.) a nd former Minnesota Supreme Court Chief Justice Eric Magnuson, who argued f or an intervenor school district in the Skeen case, about their re flections nearly three decades later and how we can use the law and a const itutional amendment to help move Minnesota’s public school system forward.< /p>
